To open the Control Center on an iPhone with a Home button or on an iPod touch, swipe up from the bottom edge of the screen.

The only way to solve the problem is to close all the applications that are running in the background on iOS, simply by double-tapping the Home button and swiping up between the open applications. After that, try the flashlight again.
